In this Newsletter, I answer the question whether a product designed using AI is protectable by copyright or design rights. I also discuss possible infringement of third-party rights by using AI in the design process. Finally, I provide some practical tips for designers and manufacturers.
Artificial intelligence in the interior industry
On 8 April 2024, at De Woonindustrie in Nieuwegein, I gave a presentation entitled Artificial Intelligence in the Interior Industry for 85 members of the VIIA (Association of Interior Importers and Agents), the NVIH (Dutch Association for Professionals with Experience in the Field of Interior Design and/or Housing Design) and the VIP (Association of Interior Design Professionals) during an exclusive networking lunch.
AI is also being embraced and widely used by interior design professionals. Developments are happening at lightning speed. And there are lots of different tools on the market. It was fun to show what, for instance, is already the difference between DALLE 2 and DALLE 3 when generating a chair. I had used different prompts for this, such as the prompt "design a chair in the style of Marcel Wanders".
With some examples from legal practice and international case law, I informed the audience about the legal implications when using AI. And finally gave Tips for using AI and AI-generated designs.
Legal advice VIIA
Nice to mention: Since 1 January 2023, I have been assisting VIIA members with primary legal advice.

Time for a new step!
After being a attorney at law and partner at Van der Steenhoven advocaten in Amsterdam for more than 30 years, I will start my own law firm Ruby Nefkens Legal on June 1, 2023.
As an experienced attorney at law in the field of intellectual property, including copyright, trademarks, designs, trade names, ICT, litigation, privacy law and commercial contracts, I can be of excellent service to you.
Having worked for the design and manufacturing industry for decades, I have a unique understanding of the issues you face.
I will continue to work together with Hylke Klasens, an independent lawyer, with whom I have formed a team for over 6 years. We are looking forward to it!
